Preliminary court hearing on HCAV v. RA Government held
14:48, February 25, 2016 | News, Own newsOn February 24, 2016, the RA Administrative Court, presided by judge K. Avetisyan, held a preliminary court hearing on HCA Vanadzor v. RA Prime Minister H. Abrahamyan, based on the claim to compel the RA Government to provide the required information. By its claim, HCA Vanadzor required that the Court obliged RA Prime Minister H. Abrahamyan to provide the data of persons awarded weapons by the RA Prime Minister in 1992-2015 by years.
The preliminary court hearing was attended by Ani Chatinyan, HCA Vanadzor lawyer and representative of A. Sakunts, Chairman of the Organization, and Edgar Andreasyan, representative of RA Prime Minister H. Abrahamyan.
A. Chatinyan, plaintiff’s representative, presented the subject and grounds of the claim. In particular, she noted that the Organization had submitted an inquiry to RA Prime Minister H. Abrahamyan on the number of persons awarded weapons by RA Prime Minister in 1992-2015 and the types of the weapons awarded as well as information by year and persons. However, the letter of the RA Government covered incomplete information by indicating only the number of the persons awarded weapons in 1998-2015 and stating that the RA Prime Minister’s decrees on awarding weapons were individual legal acts. Also, the Government failed to provide the data of the persons awarded weapons.
Hence, based on the provisions of the RA Constitution, the European Convention on Human Rights and Fundamental Freedoms and the RA Law on Freedom of Information, A. Chatinyan required that the Court compelled RA Prime Minister H. Abrahamyan to provide the information for the period of 1992-1998 requested by the Organization and the details of the persons awarded weapons. At the preliminary court hearing, the defendant’s representative and the Court raised the question of replacing RA Prime Minister H. Abrahamyan with proper defendant, i.e. the RA Government. A. Chatinyan motioned to make the due substitution, and the RA Government was declared the defendant under the case.
The Court found it necessary to appoint another preliminary court hearing on this case on March 15, 2016, at 3 pm.
