Another Pre-Trial Court Hearing on Rustam Ghazaryan’s Case Scheduled

Petrosyan, held a pre-trial court hearing on Rustam Ghazaryan v. RA MoH (Ministry of Health) Republican Narcological Center CJSC case. Note that the previous court hearing was adjourned due to the requirement to provide the Court with reliable information on the applicant’s factual residence address and original copy of R. Ghazaryan’s legal representative, HCA Vanadzor laywer T. Siradghyan’s labor contract. Hence, T. Siradeghyan provided the required documents and stated that R. Ghazaryan did not attend the court hearing due to his employment. Despite proper notification by the Court, the respondent party again failed to attend the pre-trial court hearing. The Court decided to resume the hearing without the latter. Upon presenting the subject matter and grounds of the claim, the claimant’s representative stated that R. Ghazaryan had been registered at the narcological medical facilities upon the expert opinion of the toxic and chemical examination within the criminal proceedings initiated against him. This is in conflict with the RA Law on Drug and Psychotropic Substances and provisions of the general part in the RA Government Decree № 1599 dated December 20, 2007. T. Siradeghyan also provided grounds for violations in the proceedings for choosing the adequate type of medical examination for R. Ghazaryan and diagnosing his behavioral disorders and required to restore R. Ghazaryan’s violated rights by annulling his registration as a drug user by the RA MoH Republican Narcological Center CJSC and relevant medical records. As for the adequacy of the evidence provided, the claimant’s representative stated that she had no original copies of some of the documents above and therefore motioned to the Court to apply to competent agencies for the original copies of the documents attached to the claim. The Court upheld the motion and adjourned the pre-trial hearing to both obtain the original copies of the documents in question and send a notice of retroactive notification to the respondent party. The next pre-trial court hearing is scheduled for October 8, 2015, 3:30 pm.
