Military Serviceman who Submitted a Report Has Waited for Response for Already 3 Months

He stated that on September 1, 2015, he had submitted a report to the high command requesting to be dismissed from his office at the military unit N of the RA Defense Ministry to the reserve of the RA Armed Forces, but he had received no response for months. He applied to RA Defense Minister Seyran Ohanyan to ensure that his report was processed properly. The application addressed to the Minister also remained unanswered. Based on A. Grigoryan’s application to HCA Vanadzor, on September 19, 2015, the Organization also applied to the Defense Minister to process A. Grigoryan’s report and dismiss him to the reserve of the RA Armed Forces. However, this application also remained unanswered. On November 24, 2015, HCA Vanadzor applied to the Republic of Armenia Prime Minister Hovik Abrahamyan to stop the inaction of the RA Defense Ministry and oblige it to restore A. Grigoryan’s violated rights. Actually, despite the fact that RA Government Decree № 393-N dated April 8, 2010 sets exact deadlines on dismissing a military serviceman to the RA Armed Forces reserve upon his/her report (particularly, the commander who receives the report shall undertake, no later than within 3 working days upon receiving the report, to send it with an enclosed note to the head of the human resources division of the competent agency, who, no later than within 15 days after the documents are entered at the human resources division, shall undertake to arrange the serviceman’s dismissal with the services concerned and present to the serviceman the amount of the tuition costs to be refunded), the competent authorities, including the Ministry of Defense, still show inaction by providing no response for months to the serviceman’s report and then to the application submitted to the RA Ministry of Defense on the same account. This can lead to grave and irreversible consequences, and the entire responsibility will be assumed by the RA Ministry of Defense. The competent authorities take no steps to restore the violated rights of the serviceman. A. Grigoryan has found himself in a deadlock since if the resolution of this issue is further delayed and he fails to visit the military unit, he will be accused of desertion.
