Ruling on Roland Tmoyan’s case will be announced on November 17

Arakelyan, examined the appeal of Roland Tmoyan arrested in Mashtots Park on May 13, 2014 and taken to RA Police Yerevan City Kentron Police Division. By decree of the RA Administrative Court dated July 2, 2015, he was brought to administrative responsibility for failure to comply with the legal requirement of a RA police officer or serviceman. After the Administrative Court announced the ruling above, R. Tmoyan consulted HCA Vanadzor to protect his rights and the Organization assumed protection of R. Tmoyan’s violated human rights. The hearing of October 28, 2015, was attended by the plaintiff under the initial case Sona Melikyan, representative of the RA Police, appellant R. Tmoyan and Tatevik Siradeghyan, HCA Vanadzor lawyer, who at the hearing was recognized as R. Tmoyan’s representative. Presiding judge A. Arakelyan presented the factual and legal grounds underlying the appeal. In particular, the appellants found in the appeal that the court assessed the evidence in the case incorrectly, since the case failed to substantiate the grounds for bringing a legal claim immediately to R. Tmoyan and bringing the claim in compliance with the procedure under the RA legislation. The appeal also provided grounds on the failure to properly assess the evidence under the case and take measures to assess more evidence. Based on the grounds above, the applicant party required that the Court reversed the ruling of the RA Administrative Court dated July 2, 2015, and passed another judicial act by dismissing the claim of the RA Police. S. Melikyan, representative of the RA Police, said that she objected to the appeal and considered the ruling of the Administrative Court legal. She also insisted on the arguments provided within the proceedings. Hence, the Court considered the examination of the case completed and noted that the court’s ruling will be published on November 17, 2015, at 5 pm.
