Court dismissed appeal under Hovhannes Mosyan’s case

Avetisyan, resumed examination of the appeal of Gohar and Hovhannes Mosyans, by which they requested to annul the decree of S. Arakelyan, High-Profile Cases Investigator at RA SIS General Crimes Investigation Department, dated July 31, 2015 on rejecting initiation of criminal proceedings.
The hearing was attended by appellant G. Mosyan and her representative Tatevik Siradeghyan. S. Arakelyan, responsible for the proceedings, and supervising prosecutor H. Petrosyan did not attend the hearing. A. Arakelyan had informed the court staff by phone that due to his heavy workload he would not be able to attend the court hearing and requested to hold it in his absence.
T. Siradeghyan, representative of plaintiff G. Mosyan, found that the court hearing could be resumed in the absence of the investigator responsible for the proceedings and the representative of the Prosecutor’s Office, given that they had presented their objections at the previous hearing. Also, G. Mosyan and T. Siradeghyan did not object to resuming the court hearing in the absence of H. Mosyan.
The Court found that the hearing might be resumed in the absence of the appellant, S. Arakelyan, High-Profile Cases Investigator at RA SIS General Crimes Investigation Department, and supervising prosecutor H. Petrosyan.
T. Siradeghyan submitted to the Court certain documents, particularly, a reference to the effect that H. Mosyan and G. Mosyan had been residing at their address and had not been absent from there, and the opinions of the Central Medical Commission granting H. Mosyan deferment from his military service.
G. Mosyan and T. Siradeghyan insisted on their appeal and requested the Court to annul the decree on rejecting initiation of criminal proceedings.
Considering the examination of the appeal completed, the Court retired to the deliberation room to make a ruling. By its ruling announced shortly after, the Court dismissed the appeal by upholding the decree of S. Arakelyan, High-Profile Cases Investigator at RA SIS General Crimes Investigation Department, dated July 31, 2015 on rejecting initiation of criminal proceedings.
