Prosecutor confirmed that Central Military and Medical Commission gave no instructions on organizing military service in non-standard boots

Baghdasaryan, examined the appeal of HCA Vanadzor against the decision of A. Kobalyan, investigator at the 7th Garrison Investigative Division of the General Military Investigative Department, RA Investigative Committee, on rejecting to initiate criminal proceedings based on the crime report on the commanders’ illegal decision on serviceman Razmik Petrosyan.
Note that serviceman Razmik Petrosyan spent most of his service at the military hospital because of the swelling and corns on his feet, unable to wear military boots and do his service. The decision of the Central Military and Medical Commission confirmed another time that he was unable to wear standard military boots and the commanders decided to provide him with non-standard military boots which is illegal.
The court hearing was attended by attorney S. Soghomonyan, representative of HCA Vanadzor, and A. Mazmanyan, Senior Prosecutor at Lori Garrison Military Prosecutor’s Office. As investigator A. Kobalyan was away on business trip, V. Virabyan, Deputy Head of the 7th Garrison Investigation Division of the General Military Investigative Department, RA Investigative Committee, attended the hearing.
S. Soghomonyan, representative of the Organization, presented the complaint, and then prosecutor A. Mazmanyan expressed his position requesting the Court to reject HCA Vanadzor’s complaint.
The judge asked whether the decision of the Central Military and Medical Commission of March 3, 2016 instructed to organize serviceman’s service in non-standard boots; M. Mazmanyan answered that the decision only identified the degree of the serviceman’s fitness to military service and gave no instruction on wearing non-standard boots. In response to the other clarifying questions of the Court, A. Mazmanyan mentioned that the Commission provided no opinion on the possibility for the serviceman to further continue his service. At the same time, in response to the Court’s question, he said that there had never been any such precedent.
V. Virabyan, Deputy Head of the 7th Garrison Investigation Division of the General Military Investigative Department, RA Investigative Committee, also expressed his position and requested the Court to reject the complaint mentioning that investigator A. Kobalyan carried out a thorough and objective investigation, which identified no crime.
To get familiar to the materials of the criminal case, the Court postponed the court hearing till October 19, 2016, at 11 am.
