Representative of plaintiff Compulsory Enforcement Service did not attend the court hearing

Hakobyan, examined the claim of the Compulsory Enforcement Service of the RA Ministry of Justice against Anush Poghosyan, by which the plaintiff required that A. Poghosyan was brought to administrative liability for committing an act under Article 206.5 of the RA Code of Administrative Offences, namely deliberately interfering with the duties of a Compulsory Enforcement Service officer.
The pre-trial hearing was attended by defendant A. Poghosyan, her representative Tatevik Siradeghyan, lawyer at HCA Vanadzor Office in Yerevan, and Armen Mkrtchyan, involved in the case as a third party by his own application. The plaintiff party was not represented at the court hearing.
Taking into account the fact that the pre-trial hearing established the substance and grounds of the claim, the Court considered it necessary that the plaintiff party attended the hearing. Defendant’s representative T. Siradeghyan did not object to it and also, upon being granted a relevant possibility on the part of the Court, filed a motion to declare Armen Mkrtchyan involved as a third party as an non-proper third party and withdraw him from the list of participants to trial on the grounds that the claim in question had nothing to do with his interests. A. Mkrtchyan objected to the motion by considering it groundless.
To find out the plaintiff’s position on the motion, the court hearing was adjourned. The next pre-trial hearing will be held on September 12, 2016, at 4 pm.
