Parties made final speeches on Kajik Grigoryan’s case who burnt himself on Baghramyan Avenue

Nikoghosyan resumed examination of HCA Vanadzor’s complaint against the decree dated September 29, 2016 of K. Khanumyan, Investigator for High-Profile Cases at the General Department for High-Profile Cases of the RA Investigative Committee, on refusing to initiate criminal proceedings on disclosure by N. Davidyan, Director of the Republican Scientific Center for Radiation Medicine and Burns information considered medical secret on Kajik Grigoryan who burnt himself on Baghramyan Avenue.
The court hearing was attended by HCA Vanadzor’s representative Tatevik Siradeghyan, lawyer at Yerevan Office of the Organization, and K. Khanumyan, investigator responsible for the investigation. V. Poghosyan, Senior Prosecutor at the Department for High-Profile Cases of the RA Prosecutor General’s Office, and N. Davidyan, person involved in the case, did not attend the court hearing in spite of being notified of its date and time.
Despite investigator K. Khanumyan’s objection, the Court found it possible to hold the court hearing in their absence and passed to examining the evidence available under the case, i.e. the prepared materials and then gave the parties an opportunity to make final speeches.
HCA Vanadzor’s representative T. Siradeghyan expressed her opinion that the refusal to initiate criminal proceedings based on the absence of the subjective side was indicative of the need to initiate criminal proceedings as prescribed by Article 182 of the RA Criminal Procedure Code. She also referred to the response provided by the investigative body at the previous court hearing that the disclosure of information about using drugs was not conditioned by any professional necessity and noted that the investigative body’s logic also suggested that in case the subjective side was justified the investigating body should have decided to initiate criminal proceedings. Thus, T. Siradeghyan asked the Court to grant the complaint.
K. Khanumyan, Investigator for High-Profile Cases at the General Department for High-Profile Cases of the RA Investigative Committee, insisted on his position and asked the Court to reject the complaint.
The Court found it necessary to notify once again V. Poghosyan, Senior Prosecutor at the Department for High-Profile Cases of the RA Prosecutor General’s Office, by giving him an opportunity to make final remarks.
Thus, the examination of the complaint was postponed till April 3, 2017, 5 pm.
