Forensic medical examination questioned the hypothesis that M. Sargsyan who died at detention facilities might have committed suicide
12:54, September 15, 2016 | News, Own news | Detention FacilitiesAs reported before, the criminal case initiated on causing Mkhitar Sargsyan, who died at detention facilities in March, to commit a suicide was suspended by the decision of investigator G. Mkrtchyan of June 30, 2016. The investigator supported his decision by the fact that during the preliminary investigation into the case all the possible procedural actions were taken, but they identified no person to be involved in the case as a defendant.
Interestingly, the investigator made such a decision despite the fact that the opinion of the forensic medical examination assigned within the criminal proceedings did not support the hypothesis that M. Sargsyan might have committed suicide.
The opinion particularly says: “M. Sargsyan might have committed suicide by both hanging himself, and it is not excluded that he might do so at the hands of another person.”
The investigative agency not only took no actions to confirm or reject the hypothesis of suicide, but also considered the investigative and procedural actions sufficient to make a
“reasonable” decision under the provisions of the RA Criminal Procedure Code.
The investigator’s decision to suspend the criminal proceedings was appealed by Tatevik Siradeghyan, representative of victim’s successor and lawyer at Yerevan Office of HCA Vanadzor, due to the lack of sufficient necessary grounds for making a decision to suspend the proceedings.
Based on the content of the decision to suspend the criminal proceedings, T. Siradeghyan expressed a position that the data obtained through preliminary investigation were insufficient to conclude that M. Sargsyan was deprived of life by committing suicide.
The complaint also covered the investigative and procedural actions to be taken to obtain significant evidence for the outcome of the case. Those actions also include a posthumous psychological forensic examination to find out whether M. Sargsyan might have committed suicide due to his personal qualities and peculiarities and whether he might have committed suicide in this particular situation.
