New examination on crime report under ‘Mataghis’ case to be started; the appeal was granted
16:47, June 15, 2017 | News, Own newsOn June 13, 2017 the General Jurisdiction Court of Kentron and Nork-Marash administrative districts of Yerevan city ruled on the complaint filed under ‘Mataghis’ case back on January 8, 2006.
The Court first heard complainant A. Zalyan’s opinion on the materials submitted to the Court by the representative of the RA Prosecutor General’s Office at the previous hearing. Such materials concerned the investigative actions carried out back in 2007.
A. Zalyan mentioned that the submitted documents were, among others, examined by both the European Court of Human Rights and the Cassation Court. And upon such examination, the ECtHR found that the state failed to carry out an effective investigation into the fact of torture. The Cassation Court shared this conclusion and sent the case to the first instance court for re-examination.
After hearing the complainant’s position, the Court left to the retiring room to make a ruling and granted the complaint.
Thus, new examination will be started on the crime report filed by Arayik Zalyan, Mussa Serobyan and Razmik Sargsyan with the RA Prosecutor General’s Office back on December 12, 2005.
Note that no criminal proceedings were initiated on the crime report filed with the RA Prosecutor General’s Office on the illegal deprivation of their liberty and ill-treatment on April 19-24, 2004. The complaint against the Prosecutor General’s Office of January 8, 2006 was rejected by both the first instance court and the Court of Appeals.
