Examination of complaint under Gayane Arustamyan’s case to be resumed

Avetisyan, resumed examination of the complaint filed by Artur Sakunts, Chairman of HCA Vanadzor and representative of victim Gayane Arustamyan, against the RA SIS High-Profile Cases Investigator A. Tadevosyan’s decree of August 8, 2015 not to initiate criminal prosecution and discontinue the criminal proceedings. Note that on the previous court hearing, A. Sakunts had filed the complaint and asked the Court to adjourn the hearing, so that he could get familiar with the materials of preliminary investigation.
The court was attended by the plaintiff’s representative A. Sakunts and M. Sargsyan, Prosecutor at the RA General Prosecutor’s Office. As for A. Tadevosyan, Investigator for High-Profile Cases at RA SIS, responsible for the investigation, he did not attend the hearing.
At the court hearing, the parties to the trial discussed the issue of resuming the trial in the absence of the agency responsible for the investigation.
Prosecutor M. Sargsyan noted that he did not consider it necessary that the investigator responsible for the investigation attended the hearing and left the settlement of the issue to the discretion of the Court.
The plaintiff’s representative A. Sakunts considered it mandatory that A. Tadevosyan attended the hearing since it was him who was directly responsible for the investigation into the criminal proceedings.
Having considered the issue of resuming examination of the complaint in the absence of the investigator and having heard the opinions of the parties, the Court found it impossible to resume the examination of the complaint without A. Tadevosyan. Hence, the examination of the complaint was adjourned till February 24, 2016, 10:30 am.
