Judge considers applying to the European Court to constitute a threat
14:32, February 20, 2016 | News, Own news | Karen KyupelyanAs already reported, the Court of General Jurisdiction of Kentron and Nork-Marash administrative districts of Yerevan, RA, scheduled for February 16, 2016 a next-in-turn hearing on the examination of the criminal case initiated on illegal detention of Karen Kyupelyan on RA NSS administrative premises.
Presiding judge G. Poghosyan left out a number of questions of Artur Sakunts, K. Kyupelyan’s representative and Chairman of HCA Vanadzor, which might have had significant impact on the examination of the case, on the pretext that they were not relevant to the case.
In response to the above conduct of the presiding judge, A. Sakunts stated that his questions were based on the interests of the victim and noted that the court was not bound by the preliminary investigation and should not violate the rights and legitimate interests of the victim. At the same time, A. Sakunts found that the Court interfered with his questioning of the witness and refused to address any further questions.
A. Sakunts added that the European Court of Human Rights would recognize this violation, in response to which judge G. Poghosyan argued, “Are you threatening the Court?”
In response to this question, A. Sakunts noted that the Court considered applying to the European Court to constitute a threat.
