Prosecutor did not attend the hearing for reasons unknown to the court: court hearing on Lia Misakyan’s death postponed again

Melkonyan, resumed examination of 2-year-and-3-month-old Lia Misakyan’s death on charges against Lilit Vardanyan and Zarine Ayvazyan under Article 130(2) of the RA Criminal Code.
The court hearing was attended by defendants L. Vardanyan and Z. Ayvazyan; defendant L. Vardanyan’s attorney Givi Hovhannisyan; Georgi Misakyan, successor of victim Lia Misakyan and his representative Tatevik Siradeghyan, Lawyer at Yerevan Office of HCA Vanadzor.
The prosecutor did not attend the hearing for reasons unknown to the Court and defendant Z. Ayvazyan’s attorney Y. Sargsyan had submitted an electronic request to postpone the hearing due to another court hearing on another case scheduled for the same time.
The Court noted that the hearing might not be resumed in the absence of the prosecutor and postponed it till March 15, 2017, at 5 pm.
Note that based on the aggrieved party’s appeal, the RA Cassation Court reversed the judicial acts of the lower courts and sent the case for re-examination on the part of imposing additional punishment to the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan city, RA, but no court hearing has been held so far as the prosecutor and defense counsels failed to ensure proper attendance at the court hearings.
