Preliminary investigation into the case of Serob Gevorgyan, convict deceased at Nubarashen penitentiary, is in progress

On April 20, 2015, the convict transported from Hrazdan penitentiary to Nubarashen penitentiary committed self-injury and was transmitted to hospital only after four days where he died three days later.
When the father of the deceased convict applied to the investigative agency to recognize S. Gevorgyan a victim and himself the victim’s successor, he was informed that based on the materials of the case on May 7, 2015, it was decreed to reject initiation of criminal proceedings. This decree was appealed by the victim’s successor due to its insufficient grounds; particularly, it was noted that the investigative agency failed to pay proper attention to the convict’s state before committing self-injury and the medical care he received after committing it.
The appeal was granted, and criminal proceedings were initiated under Article 130(2) of the RA Criminal Code (non-fulfillment or improper fulfillment of professional duties by medical and support personnel, which caused through negligence the patient’s death) under which Serob Gevorgyan’s father was recognized the victim’s successor and Tatevik Siradeghyan, lawyer at Yerevan Office of HCA Vanadzor, was recognized representative of victim’s successor.
Under the criminal proceedings initiated, a panel forensic medical examination was assigned according to which Nubarashen Penitentiary provided improper medical care and a number of violations were committed.
During the preliminary investigation, T. Siradeghyan submitted among others the motion on questioning the expert of the forensic expert panel examination assigned and involvement of the aggrieved party in the questioning.
The motion was granted.
