Citizens alert: there are no positive changes in their health, but they are not declared persons with disability
15:38, May 26, 2017 | News, Own newsPersons with disabilities have lately alerted on different platforms that as a result of next-in-turn medical and social examinations, some of them were not declared persons with disabilities and some others were granted a lower disability degree.
Similar alerts were also received by Helsinki Citizens’ Assembly-Vanadzor. Citizens insist that there are no positive changes in their state of health, but their disability degree changed without any proper grounds or they were not declared persons with disabilities at all.
With the support of the Organization, the citizens are going to appeal before higher instances and courts of law the Medical and Social Examination Commission’s decisions on their disability status.
With the support of HCA Vanadzor, S. G., who was not declared a person with disability after the recent expert examination, appealed the Medical and Social Examination Commission’s decision before higher instances. The complaint is based on the grounds that S. G., a persons with 3rd-degree disability, has heart problems and therefore needs regular medical care and is taken to hospital.
According to the medical documents on S. G’s health status, there are no positive changes in the state of health, but the medical and social commission neither paid due attention to this fact, nor ensured any comprehensive and impartial examination. As a result, the commission arbitrarily did not declare S. G. as a person with disability in violation of the provisions of the RA Law on Fundamentals of Administration and Administrative Proceedings.
Following the complaint, another expert examination was assigned, but the decision essentially remained unchanged.
S. G. is going to appeal the Medical and Social Examination Commission’s decision on not declaring him/her a person with disability before a court of law as well.
