There are no records on interfering with the normal course of the assembly by protestor Hasmik Evoyan

Tovmasyan, held another pre-trial court hearing under examination of the RA Police claim against Hasmik Evoyan, participant of the protest in March 2016 before examination of the motion on extending Gevorg Safaryan’s detention.
By its claim filed with the Court, the RA Police demanded that administrative sanctions were imposed on H. Evoyan under Article 180.1(11 and 15) of the RA Code of Administrative Offences.
The pre-trial court hearing was attended by plaintiff RA Police representative, Sona Melikyan, Senior Legal Adviser to Kentron Division of RA Police Yerevan city Department, and defendant H. Evoyan’s representative Tatevik Siradeghyan, lawyer at Yerevan Office of HCA Vanadzor.
T. Siradeghyan presented the ground and substance of the counter-claim on declaring the police actions unlawful and mentioned that the police actions on arresting H. Evoyan and using physical force against her led to violation of her right to freedom of assembly, freedom of expression, liberty and security of person and freedom of movement and the right to be free from torture, inhuman or degrading treatment.
Then she asked the plaintiff questions on the availability of records on violation under Article 180.1(11) of the RA Code of Administrative Offenses and noted that the section on the nature of the offense in the records drafted during preparation of the materials mentions only the failure to obey the police officer’s order and therefore, there were no records on interfering with the normal course of the assembly and given this, the proceedings of the case were to be partially discontinued.
The defendant’s representative also filed a motion on partially discontinuing the proceedings and the Court will rule on it after hearing the party’s position at the stage of trial examination.
The Court considered the case ready for trial examination and scheduled trial examination for June 6, 2017.
