HCA Vanadzor will Appeal A. Tsverianov’s Case
15:43, June 30, 2015 | News, Own newsOn June 26, 2015, the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan, RA, presided by judge A. Mkrtchyan, resumed examination of the appeal by Artur Sakunts, representative of the victim Alexandr Tsverianov, of the decree of March 31, 2015 on initiating no criminal prosecution against V. Avetisyan, Deputy Head of the RA SIS Investigation Department for Torture and Crimes against the Person and to discontinue the criminal proceedings.
Note that the previous court hearing on this appeal was adjourned for the investigating agency to submit the criminal case materials to the Court. The court hearing of June 26, 2015 was attended by the appellant A. Sakunts and V. Avetisyan, Deputy Head of the RA SIS Investigation Department for Torture and Crimes against the Person, responsible for the investigation. He presented his position on the plaintiff’s appeal and its amendment. He stated that he disagreed with the observations of A. Sakunts, and found his decree legal and well-grounded.
V. Avetisyan also objected that the time when A. Tsverianov was apprehended and the fact that he suffered violence at the police department were not evidenced by any other proof, except for A. Tsverianov’s testimonies. The affected party’s representative A. Sakunts held that it was not the persons suffering violence that should prove the fact of violence against him, but rather the state that should provide convincing evidence that the person did not suffer any violence.
By presenting all the case materials, the Court considered the examination of the appeal completed and left to the retiring room to make a decision. Shortly after, the Court announced the introductory and concluding parts of its ruling by which it dismissed the appeal on reversing the decree on not initiating criminal prosecution, discontinuing the criminal proceedings and eliminating the violation of the rights and freedoms of the victim. The HCA Vanadzor intends to appeal the court ruling before the RA Criminal Court of Appeal.
