Examination of Police claim against Hovhannes Ghazaryan postponed

Hovhannes Ghazaryan was scheduled at the RA Administrative Court, presided by judge L. Hakobyan. Note that by its claim submitted to the Court, the RA Police demanded to bring H. Ghazaryan to administrative responsibility under Article 180.1 (11 and 15) of the RA Code of Administrative Offences.
The pre-trial court hearing was attended by Sona Melikyan, representative of plaintiff RA Police and Senior Legal Adviser to Kentron Division of RA Police Yerevan city Department, as well as Tatevik Siradeghyan, lawyer at Yerevan Office of HCA Vanadzor, authorized by the defender.
The Court first verified the identities of the parties, and T. Siradeghyan’s powers were not verified as she submitted to the Court a simple written power of attorney given by Hovhannes Ghazaryan, detainee at RA MoJ ‘Nubarashen’ penitentiary facilities, whereas given his absence, a duly certified power of attorney should be submitted to the Court.
At the same time, presiding judge L. Hakobyan said that on November 18, 2016, the Court received Hovhannes Ghazaryan’s application stating that he wished to take part in the examination of his case and as he was under pre-trial detention, he requested the Court to ensure his presence at the court hearings.
Given that it was not possible to ensure Hovhannes Ghazaryan’s presence at the court hearing and his representative’s power of attorney was not formulated properly, the Court did not consider it reasonable to continue the pre-trial hearing and ruled to postpone it.
The next pre-trial court hearing on this case will be held on January 18, 2017, at 4:30 pm.
Note that Hovhannes Ghazaryan also took part in the assembly held on March 24, 2016 before the examination of the motion on extending Gevorg Safaryan’s detention and among the other participants was apprehended by force and taken to Kentron Division of the RA Police Yerevan City Department, where administrative proceedings were initiated against them based on their failure to fulfill their duties of assembly participants and obey the legal orders of the police to ensure the peaceful and normal course of the assembly.
