Everyone remembers the acquittal of Arayik Zalyan, Musa Serobyan and Razmik Sargsyan, the three young men who were for long years accused in brutal murder.
The fair verdict of acquittal was promulgated on January 18, 2012 in the RA Shirak Region Court of Common Jurisdiction.
On the very same day in an interview with journalists from several media outlets Gagik Jhangiryan, during whose office years charges were brought against A. Zalyan, M. Serobyan, R. Sargsyan, told after the verdict delivery, “They are murderers and must be convicted, I have not changed my opinion.”
Via this interview and the words stated in the address of the young men G. Jhangiryan insulted and besmirched the honor and dignity of already acquitted young people.
Willing to restore their good name and prestige, on January 15, 2013 A. Zalyan, M. Serobyan and R. Sargsyan applied to the RA Court of Common Jurisdiction of Arabkir and Qanaqer-Zeytun Administrative Districts of Yerevan with a demand to compensate for the damage caused to their prestige, dignity and business reputation as well as oblige G. Jhangiryan to make a public apology to the claimants.
On July 16, 2013 the RA Court of Common Jurisdiction of Arabkir and Qanaqer-Zeytun Administrative Districts of Yerevan declined the claim,
“Not seeing insulting or slanderous expressions in Gagik Jhangiryan’s words.”
On September 16, 2013 an appeal was filed by Arayik Zalyan, however, on November 27, 2013 the RA Court of Appeals adopted a ruling to decline the appeal.
On December 26, 2013 A. Zalyan appealed the decision of the Court of Appeals to the Cassation Court.
In the cassation appeal the claimant requests that the Court should fully abrogate the decision of the RA Court of Appeals and send the case to the same court for investigation with new personnel.
