Artur Sakunts, “Kostanyan himself will be the challenge of the judicial power”
05:52, October 14, 2013 | NewsTaking into account Gevorg Kostanyan’s activities especially during the last months: his statements which were accompanied by violations of not only professional codes but also rules of ethics related to the events that occurred in the vicinity of the house of Syunik region governor and the sensational case of the arrest of Surik Khachatryan’s son and the bodyguard, Chairman of HCA Vanadzor Artur Sakunts replied to the question of Aravot.am, “How would you assess Kostanyan’s nomination for the position of the Prosecutor General by Serzh Sargsyan?”as follows: “Frankly speaking, prior to the incident mentioned by you, I was convinced that Kostanyan would be the President’s candidate for the position of the Prosecutor General. The strange thing here is that actually the aforementioned incident didn’t have any impact over the appointment decision. So, the issue here is the following: the public opinion regarding any appointment isn’t important. If they have decided, it is continent for them, they will do so. This is a challenge to the public, of course. The public opinion regarding their activities, the responsibility for their illegal actions aren’t concerning factors and don’t have significance for decision-makers”.
To our next question whether he judicial-legal reforms about which President Sargsyan started to speak still before the presidential elections and regarding which already a legal parcel exists, which should be implemented by 2017 realizable in the context of this appointment, Artur Sakunts replied, “ We don’t have any expectations and the approved program is important merely from the legislative prospective. Whereas, our legislation is completely differs from the reality. In reality, the relations are regulated not by the legislation, but by the President’s decisions. There is no point in peaking of judicial reforms in a country where the cases of the murder of 10 people haven’t yet been revealed, the direct responsible of which are Robert Kocharyan and Serzh Sargsyan”.
According to Sakunts, by presenting a program of judicial-legal reforms, the illegitimate power actually aims to set restrictions on regulating the relations between people “outside the scope of immunity people” in certain systems. “Thus, the law is adopted not for everyone, but for those who don’t enjoying immunity”.
In this respect, Gevorg Kostanyan’s nomination isn’t at all a safeguard for implementing amendments in the system. “Kostanyan himself will be the challenge of judicial power. Until present, the political power was the decision-maker and Aghvan Hovsepyan was the implementer, and now Kostanyan can also be one of the initiators.
