Constitution as a document with legal force is cast away due to “road map”. Artur Sakunts
09:41, February 8, 2014 | News, Other newsChairman of Helsinki Citizens’ Assembly Vanadzor Artur Sakunts has examined the “road map” to accede to the Customs Union published by the RA Government and calls it anti-constitutional.
“This document proposes that the legislation of the Republic of Armenia, which relates to the accession to the Customs Union, should be made in line with the CU legal norms”, stated Sakunts adding that the legal norms which have been effective until present are in line with the Constitution and should be changed in order to bring them in line with the CU legal norms.
According to the human rights activist, it appears that the Constitution, which is a document with legal force, is cast aside and instead, documents or norms having a new legal force are adopted. “It appears that we are not leaded by the RA Constitution, but by the legal norms of the Customs Union. This is itself an anti-constitutional move”, noted Artur Sakunts.
The human rights defender added that the Republic of Armenia will also review the bilateral and multilateral agreements with other countries which do not constitute member states of the Customs Union, and again bring them in line with the CU legal norms.
“Those agreements became effective as legal norms in line with the RA Constitution only after the approval by the Constitutional Court long before the issue of joining the Customs Union came to the fore.”
A curious situation has been created: the Customs Union area comprised of those three countries: Belorussia, Russia and Kazakhstan, will entail Armenia’s isolation, since through this very document it is planned to review the obstacles which can come to the fore by the Customs Union: the decisions adopted by the RA within the composition of the World Trade Organization”, noted the human rights activist.
According to Artur Sakunts, if we look at it from the economic stance, we’ll see that the world market is much greater than those of the three countries.
“We comply the whole legislative field with a smaller market and join something that will entail our isolation. This can have its grave consequences”, noted Artur Sakunts by adding that Armenia has a number of contracts with Georgia, which should be reviewed again with the same logic.
“This documents is against the spirit of the Constitution in all aspects”, he pointed out.
