Court Ruling on Roland Tmoyan’s Case to be Appealed to Cassation Court

Arakelyan announced the ruling on the appeal of Roland Tmoyan arrested in Mashtots Park on May 13, 2014 and taken to the RA Police Yerevan City Kentron Police Division. Particularly, the RA Administrative Court of Appeals ruled to dismiss the appeal and upheld the ruing of the RA Administrative Court dated July 2, 2015. The Court dismissed the appeal on the grounds that Police representative Valery Osipyan told the assembly participants that a state ceremonial event was in progress and by their actions they hindered it by violating the public order. Afterwards, he instructed the police officers to apprehend the persons who failed to comply with the legal requirement. Hence, the Court found that the protest participants, including R. Tmoyan, were warned by a police representative about violating the public order by their actions. Given this, the Court considered baseless the appellant’s reference to the fact that he had not been given any legal requirement by any police officer. The ruling of the RA Administrative Court of Appeals dated November 17, 2015 will be appealed with the RA Court of Cassation.
