Examination of Appeal on Karen Kyupelyan’s Case Adjourned

Khachatryan, commenced examining the appeal of Karen Kyupelyan’s representative Tatevik Siradeghyan, HCA Vanadzor Yerevan Office lawyer. By her appeal, T. Siradeghyan required to annul RA SIS Senior Investigator for High-Profile Cases A. Ohanyan’s decree on not initiating criminal prosecution dated October 19, 2015.
The hearing was attended by appellant K. Kyupelyan, his representative T. Siradeghyan and A. Ohanyan responsible for the investigation.
The Court first explained the rights and responsibilities of the parties to the trial, made sure that there were no challenge motions and then noted that the body responsible for the investigation had not provided the Court with case materials. In response, A. Ohanyan, RA SIS Senior Investigator for High-Profile Cases argued that it was impossible to submit such materials, since under the initiated criminal proceedings, charges were brought against H. M., former RA NSS employee, relevant indictment was issued and approved by the supervising prosecutor, and the case was submitted to the court. However, since the investigating body was obliged to submit case materials to the court, presiding judge A. Khachatryan obliged A. Ohanyan to provide the Court with the criminal case materials in question.
Given the aforementioned, presiding judge A. Khachatryan adjourned the examination of the appeal till January 22, 2016, at 10: 30 am. Note that back on November 1, 2007, at about 6 pm, RA National Security Service officers E. N. and H. M. and another RA NSS employee apprehended K. Kyupelyan from Zvartnots Airport to the RA NSS administrative building where he was kept for almost a day.
