Examination of Appeal on Khudoyans’ Case Completed

Abovyan, examined the appeal of Tatevik Siradeghyan, representative of spouses Ashot Khudoyan and Heghine Makaryan removed from the RA Presidential Palace by a group of police officers on December 2013. Note that back on November 28, 2013, A. Khudoyan and H. Makaryan had started a sit-in in front of the RA Presidential Palace due to their apartment issue and on December 2, 2013, at the dawn were removed from that area due to the official visit of Russian President V. Putin to RA. Later on March 19, 2014, A. Khudoyan and H. Makaryan filed a claim with the RA Administrative Court to declare the RA Police actions unlawful. Upon examining the claim, the RA Administrative Court dismissed it. The judgment above was appealed to the RA Administrative Court of Appeal by HCA Yerevan Office lawyer Tatevik Siradeghyan, representative of A. Khudoyan and H. Makaryan. The court hearing of November 5, 2015 was attended by appellants’ representative T. Siradeghyan and representatives of the RA Police, Marta Meliksetyan and Mikhayil Sukiasyan. Presiding judge A. Abovyan presented the appeal that contained grounds to the effect that the RA Administrative Court had failed to assess the evidence obtained within the case by comprehensiveness, completeness and objectivity principles, which led to the dismissal of the claim. Upon analyzing the evidence within the case, the appellant party found that the available evidence might not serve as a ground to dismiss the claim and therefore declare the RA Police actions lawful. Thus, T. Siradeghyan required that the Court completely overturned the judgment of the RA Administrative Court dated May 22, 2015 and sent the case to the Court above for re-examination. Representatives of RA Police, the defendant party, objected to the appeal. Upon addressing the both parties some clarifying questions, the Court declared the examination of the appeal completed. The judicial act will be announced on November 25, 2015, at 5:15 pm.
