H. Katrjyan’s Appeal Dismissed

Bektashyan, resumed examination of Hovhannes Katrjyan’s appeal against the decree by G. Margaryan, Prosecutor at RA Yerevan City Prosecutor’s Office, on discontinuing criminal prosecution and criminal proceedings, preventive measure and search. Note that the previous hearing was adjourned for the Court to get familiar with the criminal investigation files. The court hearing was attended by appellant H. Katrjyan and his representative, HCA Vanadzor lawyer Tatevik Siradeghyan. G. Margaryan, Prosecutor at RA Yerevan City Prosecutor’s Office, did not attend the hearing. The appellant H. Katrjyan and T. Siradeghyan insisted on their appeal. Afterwards, the Court considered the appeal examination completed and went to the retiring room to make a ruling. By its ruling published after an hour, the Court’s dismissed H. Katrjyan’s appeal by upholding the decree of G. Margaryan, Prosecutor at RA Yerevan City Prosecutor’s Office, on discontinuing criminal prosecution and criminal proceedings, preventive measure and search. Note that since 1985, H. Katrjyan has been living with a cardiostimulator and in 2004 and 2008, underwent 2 surgeries at the Arrhythmology Cardiology Center of Armenia. Before his last surgery, H. Katrjyan paid the price in the pricelist for installation of a device with the manufacturer’s warranty life time of 8-10 years. However, later he found out that the manufacturer’s warranty life time of the installed device was 5 years and 5 months, and back in 2004, a used device had been installed, despite the fact that the manufacturer did not plan its re-use. Criminal proceedings were initiated against Smbat Jamalyan, surgeon and Head of the Center and were later discontinued by G. Margaryan, Prosecutor at Yerevan City Prosecutor’s Office.
