07:04, December 16, 2013 | News, Other newsThe decision of the RA Administrative Court over the claim to recognize Serzh Sargsyan’s actions as illegal was unexpected for Chairman of Helsinki Citizens’ Assembly Vanadzor Artur Sakunts. In a talk with Tert.am Artur Sakunts stated that the Administrative Court has apparently violated the principles of administrative procedure.
It should be noted that human rights activist Artur Sakunts had applied to the Administrative Court with a claim to recognize the documents and process of accession to the Customs Union and Serzh Sargsyan’s statements illegal.
“I am not naive to think that the claim should have been satisfied, but refusal to take into trial is another issue”, he stated.
Artur Sakunts also noted that the Administrative Court had fully transferred the issue to the field of signing international treaties between the states, whereas, the claim had been submitted with a number of justifications.
“We have viewed the President’s position as public management administrating body, which should be accountable and transparent before its citizens, while, the Administrative Court did not anyhow address those justifications. The Court has transferred the claim to the field of international treaties and found that the President was entitled to carry out his powers as an absolute Monarch. I have to apologize but the Administrative Court forgets that it relates to the president of a democratic Republic and a dictatorial state”, stated Artur Sakunts.
Artur Sakunts stressed that pursuant to the Constitution the president is entitled to act on behalf of the state, but such a procedure of decision-making is not typical of a democratic state and contradicts the principles of a legal state.
“Unfortunately, the Administrative Court did not pay attention to that circumstance, it is apparently a one-sided decision”, he stated. Artur Sakunts stressed that they were going to apply to the Court of Appeals and also to the Cassation Court upon necessity.
