Aghababyan, investigator at the General Department for High-Profile Cases Investigation, RA Investigative Committee, Chairman of HCA Vanadzor A. Sakunts and HCA Vanadzor lawyer A. Zalyan, in their capacity of representatives of A. Poghosyan, successor to the victim under the case of Avetisyans family murdered in Gyumri on January 12, 2015, requested information on the legal grounds for transferring the criminal case from the Russian Federation Investigative Committee to the RA Investigative Committee and attaching it to criminal case № 18100115 and the copies of relevant legal acts. In its response letter, the RA Investigative Committee referred to Article 80(1), RA Criminal Procedure Code, stating that a victim’s close relative wishing to exercise the deceased (…) victim’s rights and duties under the criminal proceedings shall be recognized successor to victim, as well as Para 4 of the Article above stating that the victim’s successor shall participate in criminal proceedings instead of the victim and have the latter’s rights and duties, and Articles 59 and 79 if the Code above regulating the rights and duties of victim’s successor. Accordingly, the response letter stated that the documents required were not included in the list of the documents accessible for victim’s successors or representatives under the RA Criminal Procedure Code and might not be accessible at the current stage of preliminary investigation.
