Preliminary Court Hearing on Rustam Ghazaryan’s Case Adjourned

Petrosyan, held preliminary court hearing on Rustam Ghazaryan v. RA MoJ Republican Narcological Center CJSC. By the claim filed with the Court, R. Ghazaryan and his legal representative Tatevik Siradeghyan, HCA Vanadzor lawyer, demanded to restore R. Ghazaryan’s violated rights by annulling the registration of R. Gazaryan as a drug user by the RA MoJ Republican Narcological Center CJSC and relevant medical records. The court hearing was attended only by R. Ghazaryan’s legal representative T. Siradeghyan. Upon referring to the provision of the RA Law on Advocacy stating that the attorney shall be obliged to attend the hearing only under regular or paid legal representation, T. Siradeghyan mentioned that she defended the plaintiff’s rights and freedoms free of charge and submitted to the Court relevant reference issued by the Chairman of the HCA Vanadzor and a copy of her labor contract. Presiding judge A. Petrosyan stated that the decree on admitting the claim, memo on the rights and notification of the court hearing submitted by the Court to the plaintiff were returned with the note ‘unknown person’. In response to this statement, the plaintiff’s representative said that she had no precise information on his residing at the permanent address submitted to the Court. Despite proper notification of the date and time of the preliminary court hearing, the Defendant Party failed to both ensure the presence of its legal representative and submit to the Court its response to the claim. To receive further details on the plaintiff’s permanent address and give time to T. Siradeghyan to submit the original copy of her labor contract, the Court adjourned the preliminary court hearing til September 18, 2015, 2:30 pm. Note that earlier R. Ghazaryan had been registered at the RA MoJ Republican Narcological Center CJSC upon the expert opinion of the toxic and chemical examination within the criminal proceedings initiated against him. In fact, R. Ghazaryan had never undergone relevant examination and learnt about his registration as a drug user a year later as he applied to relevant division of the RA Traffic Police for a new driving license.
