RA General Prosecutor’s Office and Special Investigation Service Show Apparently Negative Attitudes towards the Case on Hayk Movsisyan’s Decease

Bektashyan, resumed consideration of the appeal by Artur Sakunts and Arayik Zalyan, representatives of Heghine Petrosyan, whose son Hayk Movsisyan was found dead at the remand center in Nagorno-Karabakh Republic. Note that H. Petrosyan’s representatives applied to the Court to recognize Heghine Petrosyan as a party to litigation on the criminal case № 62202513, as well as to reverse the ruling of December 10, 2013 by the preliminary investigation agency on dismissing the criminal case and to oblige the agency to provide H. Petrosyan with copies of the materials of the case. The previous court hearing on this case was delayed to the effect of receiving case materials from the RA General Prosecutor’s Office and RA Special Investigation Service.
At the hearing, the presiding judge A. Bektashyan publicized the letters filed by RA General Prosecutor’s Office and RA Special Investigation Service. Particularly, V. Badalyan, Senior Prosecutor at the RA General Prosecutor’s Office notified the Court that he had applied to the RA Special Investigation Service to submit to the Court copies of some documents from the criminal case № 62202513. M. Babayan, Deputy Head of the RA Special Investigation Service, in his turn submitted to the Court the copies of the ruling by the senior investigator at the Special Investigation Department of Cases of Particular Importance, NKR General Prosecutor’s Office, dated March 18, 2013 on dismissing the criminal case and the ruling of the investigator at Department of Cases of Particular Importance, RA Special Investigation Service, dated December 2013 on closing proceedings on criminal case № 62202513. Furthermore, both V. Badalyan, and M. Babayan informed the Court of their absence from the hearing due to their heavy workload and asked the Court to dismiss the appeal for lack of sufficient grounds.
While Artur Sakunts, representative of the applicant Heghine Petrosyan, did not object to considering the appeal without the representatives the RA General Prosecutor’s Office and Special Investigation Service, he noted that their absence reflected their negative attitude towards revealing the circumstances of Hayk Movsisyan’s death.
In course of the court hearing, Artur Sakunts gave the legal grounds of his appeal, as well as presented the positive obligations of the state and claims on recognizing Hayk Movsisyan as the aggrieved party under the criminal case № 62202513.
The Court provided Artur Sakunts with the copies of the rulings delivered by the RA Special Investigation Service so that he could study them and state his case.
Hence, the court hearing was delayed until May 16, 2014, 12:00 p.m.
