RA SIS and the violated rights of citizens
15:22, October 15, 2014 | News, Own news | Right to Fair Trial | Special Investigation Service3rd provision of Article 2 of the RA Law on “RA Special Investigation Service” stipulates that Special Investigation Service is performed according to the RA Constitution, RA Criminal Procedure Code and preservation of legality, human and citizen rights and freedoms, honor and dignity, humanity and openness principles stipulated by other laws and regulations.
This provision of the Law implies equity; protection of human rights and impartial protection of RA citizens’ rights in any case, especially in cases when legislative, executive and judicial bodies or special public service officers abuse their authority (RA SIS Law, Article 2, part 1).
Taking under consideration these provisions of the Law, HCA Vanadzor presented crime reports to RA SIS Chief V. Shahinyan regarding violation of citizens’ rights.
These crime reports presented the violations and crime performed by the seniority of the mentioned organizations. But RA SIS did not respond to any out of 3 reports it is not even known if it made a decision based on the reports, since until now it has not been possible to receive response about decision based on reports even through an inquiry.
RA SIS is obviously inactive regarding the reports presented by the organization in the case when Code of Criminal Procedure defines the maximum shortest possible timeframes to solve reporting process.
Not receiving any response from RA SIS the organization applied to the RA General Prosecutor requesting to oblige RA Special Investigation Service to provide the decisions based on the reports of presented by the organization.
Hopefully, RA General Prosecutor will respond to the organization’s inquiry and will oblige RA SIS to provide decisions based on the presented reports.
