RA Special Investigation Service and RA Police Act as Units of the Same Agency

“Out of here, or you’ll lose your uterus!” another incident with Sashik Sargsyan”. The news report described a woman who visited the publishing house to tell about the actions of Sashik Sargsyan by particularly noting that he had used violence against a young man and then threatened and cursed an elderly woman by saying: “Out of here, or you’ll lose your uterus!” Based on the information and referring to Article 176 of the RA Criminal Procedure Code stating that “Criminal case can be initiated on the grounds below: (…) media reports on crimes”, the HCA Vanadzor submitted a letter to the RA Special Investigation Service and the Prosecutor General’s Office. In its response, the RA SIS stated that the letter by the HCA Vanadzor might not be considered as a crime report, referring to Article 190(6) of the Criminal Procedure Code stating that the RA Special Investigative Service shall carry out preliminary investigation on the cases committed by the major officers of the legislative, executive and judicial government agencies and persons responsible for special state services by abuse of power or their complicity in crimes, including criminal cases related to election process. The RA Prosecutor General’s Office has not responded yet. In fact, the media report posted on the hraparak.am website on October 9, 2015 mentioned that the 6th Police Department examined the application above filed by A. Sakunts and required the sources of the news report. It is quite noteworthy that the news report contained the section below: “the law enforcement say: what should we do? Here is the application; if we do not process it, we’ll be accused of ignoring the application of an NGO chairman”. Actually, the allegations by Hraparak that the 6th Police Department examines the application of A. Sakunts and those by law enforcement officers on not ignoring the application by an NGO chairman suggest that the RA Special Investigation Service and the RA Police act as units of the same agency, since as mentioned above, the RA SIS letter makes it clear that the application was not processed, nor was the application forwarded to the RA 6th Police Department, and the RA Prosecutor General’s Office left the application unanswered.
