The cardiologist of the Drafting Commission neglected the diseases of the conscript, which resulted in the latter’s death

Ani Chatinyan, a lawyer at HCA Vanadzor, is representing the interests of S. Mosinyan’s legal successor.
Seda Tadevosyan, a cardiologist at the Regional Drafting Commission of Artashat, is accused of causing Suren Mosinyan’s death. Under Part 2 of Article 315 of the RA Criminal Code, S. Tadevosyan is charged with professional negligence, which has resulted in death.
During the compulsory ECG examination on March 4, 2015 conscript Suren Mosinyan was diagnosed with “sinus arrhythmia, 110 beats per minute and signs of an oversized right atrium”. The given diagnosis serves as evidence for the pathological disorders of the cardiovascular system, on the basis of which cardiologist Seda Tadevosyan had to refer him to undergo additional examinations. However, cardiologist Seda Tadevosyan, neglecting the medical documents on this matter, considering that the given conclusion was sufficient, recognized Suren Mosinyan as fit for military service and on July 25, 2015 he was drafted. However, later the conclusions made in regard to the criminal case indicated that if relevant examinations had been carried out and the diagnosis had been confirmed, Suren Mosinyan would have been recognized as unfit for military service and released from military service.
When carrying out military actions on May 29, 2016, S. Mosinyan’s health deteriorated dramatically and he passed away on the way to the military hospital.
The cardiologist of the Regional Drafting Commission of Artashat was charged on the basis of complex forensic and military-medical examinations conducted in regard to the criminal case.
In accordance with the conclusion of the conducted examinations, cardiologist Seda Tadevosyan was able to foresee that not treating the disease would lead to negative outcomes, including death.
Within the frameworks of the case hearing at the Court of General Jurisdiction of Ararat and Vayots Dzor Provinces on November 1, 2017, the witnesses of the case – Alla Ghazaryan, a therapist at the Regional Drafting Commission of Artashat, and cardiologist Ashot Gevorgyan, were interrogated.
It became clear from the testimonies of the witnesses interrogated that for a person with a heart disease the normal heartbeat rate should be 60/90 or 60/100, although, despite this, the doctors claimed at the court that S. Mosinyan’s recorded heartbeat rate 110 was also considered to be normal. It is also noteworthy that the questioned doctors considered the diagnosis “sinus arrhythmia, 110 beats per minute and signs of the oversized right atrium” normal. They claimed that there was no risk of either cardiovascular or other diseases or disorders.
The witnesses’ interrogation is to be carried on during the next hearing, which is scheduled for 2.00 pm on November 21, 2017.
