The court declared unlawful the actions of the police against the protester
19:31, June 7, 2018 | News, Own newsToday, on June 7, 2018, the RA Administrative Court rejected the claim of the RA Police against Mashtots Avenue protester G. Tonoyan and upheld in part the counterclaim filed by G. Tonoyan and her representative T. Siradeghyan, lawyer at HCA Vanadzor’s representative office in Yerevan.
It should be recalled that the RA Police demanded to hold the protester liable under Article 180.1 (11 and 15) of the RA Code on Administrative Offenses.
G. Tonoyan and her representative demanded to declare the police actions unlawful.
The court held that G. Tonoyan’s being on the carriageway of Mashtots Avenue could not have obstructed the normal course of the peaceful assembly; therefore, even if the police had put forward the demand to free the carriageway of Mashtots Avenue, it could not have been a demand on ensuring the normal course of the peaceful assembly as set forth by law.
The court declared unlawful the actions of arresting G. Tonoyan and using physical force against her, which led to the violation of her rights to freedom of assembly, freedom of expression, personal liberty and inviolability as well as the right to freedom of movement.
