The Yerevan Municipality employee involved as a witness in the case against the Mayor of Yerevan failed to show up at the session; the Court ruled an enforced appearance of the witness

Simonyan against the Municipality of Yerevan and ruled an enforced appearance of the witness, namely employee of the Municipality K. Begrakyan, who failed to appear at the court session.
On October 11, 2017, A. Martirosyan, Head of the Investigation Division for Administrative Violations by the Staff of Yerevan Municipality, imposed an administrative penalty on G. Simonyan for carrying out works of renovating and fortifying the wall of the apartment balcony.
The resident appealed the decision before Mayor of Yerevan Taron Margaryan. After receiving a rejection, he applied to the Court with HCA Vanadzor’s support.
During the court session held on July 3, claimant’s representative Tatevik Siradeghyan, lawyer at HCA Vanadzor’s representative office in Yerevan, presented grounds to support that G. Simonyan carried out small-scale construction works, which do not require a construction permit. Apart from that, other residents carried out such works as well but they had not been subjected to a penalty. On these grounds, G. Simonyan evaluated the works carried out as not requiring a construction permit.
On the basis of the claimant’s motion, E. Bagrazyan, G. Simonyan’s neighbor, was questioned as well.
Afterwards, the Court ruled a forced appearance of K. Begrakyan, the witness involved in the case who works at the Public Order Protection Service of the Staff of Yerevan Municipality of the RA, since he was properly notified but did not show up before the Court.
The next court session was scheduled for 11.30 am on September 24, 2018.
