Republic of Armenia did not fully recognize violation of Hayk Movsisyan’s rights

Հայկ-ՄովսիսյանHelsinki Citizens’ Assembly Vanadzor carries on restoring the violated rights of military serviceman Hayk Movsisyan deceased in pre-trial detention cell in NKR on November 27, 2012. Note that he had been drafted with mental health problems. Later during his military service, criminal proceedings were initiated against him for committing self-injury to avoid his service duties temporarily. Several days after the announcement of the judgment on this case, H. Movisisyan was found dead in a pre-trial detention cell in NKR.

Hayk Movsisyan’s case appeal rejected

Petrosyan continued the hearing on a complaint against the decision of the general provision Court of the Kentron Nork-Marash administrative unit of Yerevan city regarding the case of Hayk Movsisyan died in the NGKR investigation isolator. Hayk Mosvisyan’ interests were presented by his mother’s Heghine Petrosyan’s legal representatives Artur Sakunc and Arayik Zalinyan.

Petrosyan continued the hearing about the legality and propriety of the question and judicial review of Kentron Nork-Marash District Court of Appeal’s decision based on the appeal presented by Arthur Sakunts and Arayik Zalinyan representatives of Heghine Petrosyan mother of Hayk Movsisyan who died in the investigation isolator in NGK.

RA Justice Committee does not notice any violations

Hayk_Movsisyan_2On October 31, 2014 RA Court of Criminal Appeal held Hayk Movsisyan’s case hearing. We have referred to the criminal case on Hayk Movsisyan’s death for many times, which was quashed by the investigation bodies considering his death as a suicide case on the bases of evidence insufficiency but Hayk Movsisyan was not recognized as a victim and his mother Heghine Petrosyan was not recognized a successor as a result of which Hayk Movsisyan’s rights have been violated.

Hayk Movsisyan’s mother was again rejected recognition as successor to the aggrieved party

HCA_7643[1]As we have already informed, on May 19, 2014, the Court of General Jurisdiction of Kentron and Nork-Marash administrative districts of Yerevan, RA, presided by judge A. Bektashyan, announced its ruling on the appeal by Artur Sakunts and Arayik Zalyan, representatives of Heghine Petrosyan, on the case of Hayk Movsisyan who was found dead at the remand center in Nagorno-Karabakh Republic. The court dismissed the appeal on the ground of Article 290 of the Criminal Procedure Code of the RA.
