Appeal on points of law on the case of Lia Misakyan’s death was granted in part
17:06, June 24, 2016 | News, Own news | Children's rights, Right to Life | Lia MisakyanToday, on June 24, 2016, the RA Court of Cassation ruled to grant in part the appeal on points of law submitted by Artur Sakunts, Chairman of Helsinki Citizens’ Assembly-Vanadzor and representative of successor of the victim under the case of 2-year-and-3-months-old Lia Misakyan who died at Arabkir Medical Center on January 3, 2013.
Note that the appeal on the points of law required reversing the judicial act of the RA Court of Criminal Appeals of December 22, 2015, as well as modifying the imprisonment sentence imposed on Lilit Vardanyan and Zarine Ayvazyan and impose a supplementary punishment on them by depriving them of the right to engage in certain activity for 3 years and 2 years, respectively.
The appeal was upheld only in its last part. By the ruling of the Court of Cassation, the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts will carry out a re-examination of the case in terms of imposing additional punishment.
Note that by the judgment of the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts, Lilit Vardanyan and Zarine Ayvazyan, physicians on duty at ‘Arabkir’ Medical Center were found guilty under Article 130(2) of the RA Criminal Code (Failure to implement or improper implementation of professional duties by medical and support personnel which caused through negligence the patient’s death) and sentenced to 2 years’ and 2-year-and-6 months’ imprisonment, respectively, without any additional penalty. At the same time, the Court applied Para 4(1) of the Amnesty Act to mark the 22nd anniversary of the RA independence and exempted the defendants from punishment.
