Examination of Appeals on Lia Misakyan’s Case Resumed

Avetisyan, resumed examination of the appeals of the representatives of the victim’s successor and attorney of the defendants on the case of 2-year-and-3-month old Lia Misakyan. Note that the previous court hearing on this case was adjourned due to another case previously scheduled by the court. The court hearing was attended by defendants Z. Ayvazyan and L. Vardanyan, her attorney Givi Hovhannisyan, prosecutor Davit Karapetyan and the legal representative of victim’s successor Tatevik Siradeghyan. Z. Ayvazyan’s attorney Y. Sargsyan was late for the hearing. Victim’s successor G. Misakyan and his representative A. Sakunts did not attend the hearing due to their heavy workload, but their absence did not prevent resuming the hearing. In his appeal, L. Vardanyan’s representative G, Hovhannisyan, provided substantiation to the effect that his client’s action contained no features of the act under Article 130 of the RA Criminal Code. He also mentioned the groundlessness of the forensic re-examination opinion and violations committed by the Court. In particular, G. Hovhannisyan stated that the Court had denied the motions in support of innocence of the defendants and did not give an opportunity to question Argam Hovsepyan, chairman of the forensic examination and eye-witness nurse Lusine Minasyan.
Also, arguments were provided that the Court showed prejudiced and biased attitude. To sum up the appeal, G. Hovhannisyan asked the Court not to violate L. Vardanyan’s right to a fair trial and to examine and uphold the motions declined without any reasons by the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts, Yerevan, and to change the ruling by General Jurisdiction Court of first instance of Arabkir and Kanaker-Zeytun administrative districts of Yerevan dated June 15, 2015 and make a verdict of not guilty by recognizing L. Vardanyan not guilty of the charges brought to her. The court hearing was again adjourned due to another court hearing scheduled. The next hearing is scheduled for November 5, 2015, 1 pm.
