The doctor charged with the death of a four-year-old child will compensate the aggrieved party for material damages in the amount of 890,000 AMD

Petrosyan, the doctor charged with the death of a four-year-old child Karine Hovhannisyan, who died at Armavir Medical Center in 2015, is to compensate the aggrieved party for material damages in the amount of 890,000 AMD.
On June 2, 2016 A. Petrosyan was sentenced to three years in prison for failing to provide proper medical aid. She was thus deprived of the right to hold certain positions for a period of 1 year and 6 months (the aforementioned doctor was also charged with the death of Erik, a five-year-old resident of the same province). A. Petrosyan is now serving her sentence in an open regime.
Hakob Hovhannisyan, Karine Hovhannisyan’s legal successor, and his representative Ani Chatinyan, advocate at HCA Vanadzor, claimed a compensation for material damages from A. Petrosyan, the doctor who caused the death of the child, in the amount of 2,000,000 AMD.
With the claim submitted to the General Jurisdiction Court of Armavir Province, they presented grounds pertaining to the four-year-old child being under state oversight, and in that case the state was obliged to guarantee the right to life, which is established not only by the RA Constitution but also by the European Convention on Human Rights.
As a consequence of Anahit Petrosyan, doctor at Armavir Medical Center, committing an act prohibited by the Criminal Code, the aggrieved party suffered material damage, which is subject to compensation in the sense of Article 1058 of the RA Civil Code.
The defendant’s objections to part of the presented claims were considered justified by the Court, which ruled that 890,000 AMD should be confiscated from Doctor Anahit Petrosyan in favor of Hakob Hovhannisyan.
Anahit Petrosyan will also pay state duties in the amount 17,800 AMD to be paid for the upheld claim.
Ani Chatinyan, Hakob Hovhannisyan’s representative, has also submitted a claim for moral compensation from the RA Government, Armavir Medical Center and Anahit Petrosyan in the amount of 15,000,000 AMD. The Court has not started proceedings yet.
