Counter-claims on declaring police actions unlawful were submitted on protesters’ case
11:05, December 13, 2016 | News, Own news | PoliceOn December 8, 2016, the examination of the RA Police claim on imposing an administrative sanction on Naira Badalyan was scheduled at the RA Administrative Court. Naira Badalyan took part in the assembly held before the examination of the motion on extending Gevorg Safaryan’s detention in March.
At the pre-trial court hearing attended by Sona Melikyan, representative of the RA Police, and defendant N. Badalyan’s representative Tatevik Siradeghyan, Lawyer at Yerevan Office of HCA Vanadzor, the Court stated that on December 2, 2016, it had received N. Badalyan’s counter-claim on declaring the RA Police actions unlawful. The court hearing was postponed so that the Court ruled on admission of the counter-claim.
Later, the Parties received the ruling on admitting the claim.
The court hearing on the case of another assembly participant Geghetsik Tonoyan held on December 8, 2016 at the RA Administrative Court was also postponed on the same grounds.
Her interests are also protected by Tatevik Siradeghyan, Lawyer at Yerevan Office of HCA Vanadzor.
The parties will be further notified of the next pre-trial court hearings.
By its claim submitted to the court, the RA Police required that administrative sanctions were imposed on the assembly participants under Para. 11 and 15 of Article 180.1 (Violating the assembly procedure established by law) of the RA Administrative Code.
Note that a number of the assembly participants were apprehended by force and taken to Kentron Division of the RA Police Yerevan City Department. Administrative proceedings were initiated against them there based on their failure in performing the assembly participants’ obligations and the legal orders of the police to ensure the peaceful and normal course of the assembly.
