Defendant’s attorney not present at the examination of 2-year-and-3 month-old Lia Misakyan’s death

The hearing on the examination of 2-year-and-3-month-old Lia Misakyan’s death to be held today at the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts did not take place.
Defendant Zarine Ayvazyan’s attorney Yerem Sargsyan did not attend the hearing due to taking part in a seminar and filed a written application to postpone the hearing.
Note that after the RA Cassation Court reversed the judicial acts of the lower courts based on the aggrieved party’s appeal, the case was sent to the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan city, RA, for re-examination on the part of imposing additional sanction.
At the previous court hearing, defendant Z. Ayvazyan’s attorney Y. Sargsyan motioned to apply to the Constitutional Court to challenge the constitutionality of Article 419 of the RA Criminal Procedure Code. The motion was supported by the fact that in his opinion, the Court was restricted by the Cassation Court’s judgment as according to the said Article it should examine the case to the extent determined by the RA Cassation Court.
Tatevik Siradeghyan, representative of the victim’s successor and lawyer at Yerevan office of HCA Vanadzor, and the prosecutor objected to the motion. The Court rejected the motion.
