Major of police to be brought to responsibility for abuse of powers

G. who suffered illegal actions of law-enforcement agencies, on April 12, 2016 HCA Vanadzor applied to the RA Prosecutor General’s Office to stop the inaction of the RA Special Investigation Service and compel it to make a decision under Article 181 of the RA Criminal Procedure Code.
Note that the RA Special Investigation Service made no decision in compliance with the RA Criminal Procedure Code on the crime report submitted by HCA Vanadzor based on a citizen’s application; instead, the crime report was readdressed by a letter to the Internal Security Departments of the RA Investigative Committee and of the RA Police to carry out an official investigation.
The response letter of the RA Prosecutor General’s Office of April 22, 2016, actually guides the Organization to turn to a court of law stating that the requirement of the application was beyond the prosecutor’s powers, whereas the RA Criminal Procedure Code clearly stipulates that the prosecutor’s powers of supervising the pre-trial proceedings also include initiating and carrying out criminal prosecution and annulling the decision of the investigating agency and the investigator on rejecting the initiation of criminal proceedings.
However, more than 2 months after submitting the crime report, on May 17, 2016, the Internal Security Department of the RA Police made a decision to bring to responsibility Major of Police Narek Khachatryan, Head of the Criminal Investigations Unit of Spitak Division of RA Police Lori Marz (Region) Department for inappropriate talk with citizens and improper fulfillment of his official duties, based on the findings of the official investigation carried out following the information submitted by the citizen.
It is noteworthy that the letter of the Internal Security Department of the RA Police does not detail on the type of responsibility the police officer who abused his powers would face; by the way, abusing powers is an act sanctioned by criminal law.
At the same time, it is reported that the opinion resulted from the findings of the official investigation was sent to the Head of Lori Marz (Region) Police Department to prevent similar violations in the future and investigate in a proper way the other circumstances mentioned by R. G.
