Court to decide that trial conducting body over the child’s case who died in “Arabkir” medical center committed violations

Although we record that fair judicial acts are sometimes released in our country by acting solely in line with the principles and provisions as prescribed by the RA legislation. Such a decision was also made upon disputing the legality of the decision of the court trial body over the case of Elen Parsadanyan, who had died in “Arabkir” medical center on refusing to file a criminal case.
The regular court hearing over the case of toddler Elen Parsadanyan, who had died in the medical center, was held in the RA Court of Common Jurisdiction of Arabkir and Qanaqer-Zeytun Administrative Districts of Yerevan on January 31, 2014.
The previous court hearing over the same case was put off in order to provide E. Parsadanyan’s mother applicant Lusine Parsadanyan and her representatives with a chance to get familiarized with all of the case materials.
During the court hearing representative Artur Sakunts informed that after getting acquainted with all of the case materials, it turned out that E. Parsadanyan’s medical card/comprised of 75 pages/ was not attached to the case materials, which did not allow confirming the authenticity of the medical history facts mentioned in the forensic-medical conclusion.
L. Parsadanyan’s representatives A. Sakunts and A. Chatinyan claimed on the appeal submitted by them, to which the supervising prosecutor over the case and the investigator having conducted the trial objected considering that the preliminary investigation had been conducted in line with law and a decision to refuse filing a criminal case was made due to absence of grounds.
Judge A. Mkrtchyan retreated to the conference room to adopt a verdict and several minutes later delivered its verdict satisfying the appeal submitted by Lusine Parsadanyan, as well as her representatives A. Sakunts, A. Chatinyan and A. Zalyan with a demand to abolish the decision of the RA Police Arabkir Investigative Department investigator G. R. Agajanyan to refuse filing of the criminal case. In case the current decision is not appealed it will enter into force in a 15-day term after its promulgation, later it will be sent for additional preliminary investigation.
