Police Inaction Backed Up by Prosecutor’s Office

According to the claim, S. Gh. acquired a personal computer by signing a sale and purchase contract with the Company, but made no payments. S. Gh. insisted that he had never needed any computer and signed no sale and purchase contract with the Company. Also, the Organization learnt that S. Gh. was registered at psychoneurologic dispensary. He also reported having lost his passport and expressed doubts that someone might have used it for the purposes above. The handwriting expert examination verified the identity of the signature in the contract and the one submitted for examination. The facts above suggest that S. Gh. might not have signed the sale and purchase contract, especially taking into account his statements on having no computer and internet skills and never experiencing any such need. Also, S. Gh. insisted that he had never seen the equipment mentioned in the claim. Based on the facts above, on April 27, 2015, the HCA Vanadzor filed a crime report with the Vanadzor City Bazum Division, RA Police Lori Marz (Region) Department. For months, the Organization had no news on the decree concerning investigation into the case (the police did not admit the crime report as such and provided a written response instead of taking relevant decision under Article 181, Criminal Procedure Code). On August 27, 2015, the Organization submitted a letter of complaint to the Lori Marz (Region) Prosecutor’s Office to oblige S. Avetisyan, Chief of the Vanadzor City Bazum Division, RA Police Lori Marz (Region) Department to decide on the crime report and inform thereof the legal entity that had submitted the report (the letter of complaint was admitted as a crime report). Consequently, S. Poghosyan, Senior Investigator at the Vanadzor City Bazum Division, RA Police Lori Marz (Region) Department, decreed to reject the motion on initiating criminal proceedings. By its appeal to G. Elizbaryan, RA Lori Marz (Region) Prosecutor General, dated September 18, 2015, the HCA Vanadzor requested to annul senior investigator S. Poghosyan’s decree to reject initiating criminal proceedings as well as to initiate criminal proceedings, give a legal assessment to the violations above committed by the Vanadzor City Bazum Division, RA Police Lori Marz (Region) Department and forward it to competent authorities for relevant investigation.
By its response letter, the RA Lori Marz (Region) Prosecutor’s Office dismissed the appeal considering it baseless. In fact, the Vanadzor City Bazum Division, RA Police Lori Marz (Region) Department committed a series of violations by taking no actions on the crime report and only admitting the complaint letter as a crime report. Also, the police failed to take any measures to locate the property actually owned by S. Gh. (except for the letter submitted to ArmenTel CJSC, which remained unanswered and no subsequent steps were taken). Also, the police ignored S. Gh.’s statement on losing his passport which might be of essential significance. Hence, the police shows inaction, and the prosecutor’s office backs it up.
