RA SIS does not provide all materials related to Hayk Movsisyan’s case to the RA Court of Criminal Appeal

Petrosyan continued the hearing about the legality and propriety of the question and judicial review of Kentron Nork-Marash District Court of Appeal’s decision based on the appeal presented by Arthur Sakunts and Arayik Zalinyan representatives of Heghine Petrosyan mother of Hayk Movsisyan who died in the investigation isolator in NGK.
It should be reminded, that the previous hearing of the case was postponed to acquire all the necessary materials of the quashed case from RA Special Investigation Services. RA General Prosecution office’s senior prosecutor V. Badalyan and the deputy head of RA Special Investigation Services did not attend the hearing again. The latter, had written a letter to the court informing that he objected the appeal presented to the Court of Criminal Appeal but he could not attend the hearing because of very busy working schedule and requested to excuse his absence. Besides, A. Babayan presented the materials of the quashed case to the Court, that had already been presented to the Court of First Instance. Presiding judge M. Petrosyan informed those were returned to the investigating body. A. Zalinyan the representative of the plaintiff H. Petrosyan did not object to proceed to the hearing without the investigating body and the representative of the prosecution and the court proceeded to the hearing of the appeal considering the facts and guided by the requirements of article 290 of RA Code of Criminal Procedure. The Court announced the introductory and concluding points of the judicial act of Kentron Nork-Marash District Court of Appeal, Yerevan city, RA, as well as the concluding part of the appeal. The representative of the plaintiff briefly presented the justifications of appeal and the main points that had not been examined by the investigating body or the court but that could be of importance in the process of discovering the circumstances of Hayk Movsisyan’s death in the investigation isolator in NGK.
Presiding Judge M. Petrosyan informed that he requested form RA SIS to present full materials on the dismissed case and considered necessary to postpone the hearing on that basis. The examination of the appeal presented by the plaintiff H. Petrosyan’s representatives A. Sakunts and A. Zalinyan will be continued at 11:00, November 27, 2014.
